working instructions for measures of shanghai municipality on implementation of housing provident fund withdrawal due to housing rent payment
the working instructions is enacted to ensure implementation of measures of shanghai municipality for hpf withdrawal due to housing rent payment (shgjjg no. 7<2014>).
1. withdrawal eligibility and scope
any employee (hereinafter referred to as the applicant) corresponding to one of the following criteria is eligible for requesting withdrawal of hpf savings in the personal account for housing rent payment purpose.
(1) lessees of low-rent housing, public rental housing or other security housing of the municipality acknowledged by the government;
(2) lessees of other types of residential housing of the municipality such as commercial residences and self-owned subsidized public housing, whose monthly housing rent exceeds 20% of the monthly household income.
co-withdrawal can be processed given that the applicant’s hpf savings in the account is insufficient and the co-withdrawers (the designated account holders) authorizes the applicant in written form to withdraw hpf savings in their respective accounts. co-withdrawers must be the applicant’s spouse, parents or children.
2. withdrawal cap
(1) as for lessees of low-rent housing, public rental housing or other security housing of the municipality acknowledged by the government, hpf withdrawal can be processed as per actual housing rent of the month;
(2) as for lessees of other types of residential housing of the municipality such as commercial residences and self-owned subsidized public housing, hpf withdrawal shall be processed as per the monthly housing rent deducting 20% of the monthly household income, and the monthly withdrawal must not exceed 2000 yuan.
3. supporting documents for withdrawals
following supporting documents are required for application for housing provident fund withdrawal:
1) identity credential
(1) the applicant’s identity credential;
(2) where applicable, identity credential(s), relationship testimonial(s) (such as marriage certificate and household register), written consent(s) of the co-withdrawer(s) are required
2) the completed housing rent payment oriented hpf withdrawal request form;
3) withdrawal purpose related documents
(1) as for lessees of low-rent housing of the municipality,
i) the low-rent subsidized housing notice or the low-rent housing subsidy agreement;
ii) the lease contract;
iii) the evidence indicating the filing of the lease contract.
the above withdrawal purpose related documents are not required given that the applicant requests hpf withdrawal for tenancy of the same housing again.
(2) as for lessees of public rental housing of the municipality,
i) the subsidized public rental housing endorsement acknowledged by the housing security authority of the municipality (the endorsement document can be waived provided that the public rental housing endorsed by the housing security agency of the municipality has been reported to and filed by spf center ).
ii) shanghai public rental housing lease contract
iii) the tax control invoice indicating the housing rent is already paid, and the like
the above i) and ii) documents are not required in the event that the applicant applies for hpf withdrawal for the tenancy of the same flat.
(3) as for lessees of other types of residential housing of the municipality such as commercial residences and self-owned subsidized public housing,
i) the lease contract;
ii) the evidence indicating the filing of the lease contract;
iii) the tax control invoice indicating the housing rent is already paid, and the like
the above i) and ii) documents are not required in the event that the applicant applies for hpf withdrawal for the tenancy of the same flat.
4. cautions as to approval reviews
(1) withdrawal eligibility
withdrawal of hpf due to housing rent payment should comply with the following requirements:
(1) the applicant and the co-withdrawer(s) have made housing provident fund payment for six months in total at the least;
(2) the applicant and the co-withdrawer(s) currently have no housing provident fund loans, no housing provident fund withdrawal entrusted for repayment of home loans or for property service charges payment.
(3) housing provident fund withdrawals can be used by the applicant or the co-withdrawer(s) for housing rent payment for only one set of the apartments;
(4) tenancy of the applicant should conform to relevant regulations on housing lease within the municipality.
(2) withdrawal procedures
i) applicants eligible for hpf withdrawal due to rent payment may submit their applications to their respective district/county management divisions of spf center (hereinafter referred to as the district/county management division) at the locations of the rental housing, together with the pertinent supporting documents as required.
ii) the management divisions shall determine the approval or disapproval of the withdrawal applications and notify the applicants within three workdays from the date of application receival. the district/county management division has the right to require the applicant to further provide other valid testimonials given that any doubt arises over the submitted supporting documents for the application in process.
iii) upon consent of the withdrawal application, the applicant may carry the approval sheet and the withdrawal related documents to the designated ccb outlet for fulfillment of withdrawal procedures. as for denied withdrawal requests, the handling agency should specify the reasons.
(3) withdrawal time limit
housing provident fund withdrawal for housing rent payment shall be processed on a quarterly basis. the applicant can withdraw housing provident fund once every quarter. namely, the withdrawal interval being three months, and the withdrawal cap set at the equivalent of three months’housing rent. the applicant’s application for hpf withdrawal for housing rent payment should be submitted within the prescribed term of the tenancy, with a six-month grace period extending from the termination of the tenancy.
the measures shall be effective as of 1st october 2014. hence, operational measures on housing provident fund withdrawal of employees of shanghai municipality for housing rent payment (shgjj no. 47 <2009>), released by shanghai provident fund management center on 14 september 2009, shall be abrogated.
