i. application conditions:

1. the borrower's divorce, death and other legal reasons occur;

2. there is no default principal, interest, principal penalty interest, interest penalty interest, expenses required to realize the creditor's rights, losses to the lender caused by the borrower's default, and all other expenses payable;

3. the new borrower shall meet the following conditions:

(1) for the city's normal housing provident fund workers, including voluntary deposit;

(2) the provident fund account is unique and not frozen;

(3) having full capacity for civil conduct;

(4) have reached the age of 18 and have not reached the legal retirement age;

(5) have good credit record and repayment intention;

(6) the new borrower's family has no provident fund loan under application, no outstanding provident fund loan other than this loan, or other debts that may affect the repayment of provident fund loan, and the repayment ability shall be in accordance with the calculation standard of loan application;

(7) there are no unterminated provisions on the withdrawal of housing provident fund (including but not limited to the agreement on the withdrawal and repayment of housing provident fund, the agreement on the withdrawal and payment of rent and other provisions on the withdrawal and repayment of housing consumption, etc.), except for the withdrawal and repayment agreement for the change of the provident fund loan;

(8) there is no unsettled "certificate of payment and use of housing accumulation fund for employees with loans from other places", including the status of "certificate of payment and use of housing accumulation fund of employees with loans from other places" is not cancelled, there is no receipt, and there is a receipt of loan approval but no settlement certificate;

(9) in case of change due to divorce, the new borrower shall be the spouse of the original borrower;

(10) if the provident fund loan in the portfolio loan is changed, it shall also meet the conditions for the change of the commercial loan application, and the new borrower after the change of the provident fund loan must be consistent with the new borrower of the commercial loan;

4. other conditions stipulated by the municipal provident fund management committee or the municipal provident fund center.

ii. the new borrower shall not be changed under any of the following circumstances:

1. the credit cards and loans in the personal credit report of the credit reference center of the people's bank of china are overdue and have not been paid back at present;

2. credit card and loan overdue records of 6 consecutive periods (inclusive) or accumulated more than 12 periods (inclusive) in the last 5 years;

3. being included in the list of persons to be executed for breach of faith;

4. providing false information or making false promises;

5. being included in the list of individual serious dishonest behaviors of the municipal provident fund center due to fraudulent withdrawal of housing provident fund by means of forging contracts, issuing false certificates, fabricating false leases in the past three years, or being included in the list of individual serious dishonest behaviors of the municipal provident fund center due to illegal acquisition of provident fund loans by deception within the last five years;

6. there are other situations that may affect the safety of provident fund loans.

iii. place of application:

1. loans accepted before august 1, 2020:

the business network of shanghai estate guaranty co.,ltd. portfolio loan’s borrower should go to the original lending bank branch to check the change of commercial loan first.

2. loans accepted after august 1, 2020:

original loan acceptance network.

iv. application requirements:

1. identity certificate and household registration certificate: the original id card of the borrower, co-borrower, co-owner of property right and the spouse of the above-mentioned persons before and after the change (if minors do not have id card, birth certificate shall be provided), original and copy of household register of the borrower, the co-borrower and the co-owner of the property right before and after the change. for hong kong, macao and taiwan residents, shall provide the original of hong kong and macao residents' travel permit to the mainland, taiwan residents' travel permit to the mainland or hong kong, macao and taiwan residents' residence permit. foreigners and those who have obtained permanent (long-term) right of abode abroad shall provide the original passport and the chinese translation name confirmed by their signature. non mainland residents should provide the domestic contact person’s information (including name, id number and contact information) and id. if the person is an adult with limited (no) capacity for civil conduct, the original and copy of guardian certificate shall be provided.

2. proof of relationship: the original and copy of marriage certificate, household register, birth certificate, one-child certificate, etc. which can reflect the relationship between the applicant before and after the change. if single, the original letter of commitment shall be provided. if hong kong, macao and taiwan people do not register their marriage in the mainland, they shall provide the original and copy of marriage certificate notarized by the notary office of their residence (hong kong, macao or taiwan). married people in taiwan can provide taiwan id card (see details of family members on the back). if the marriage is registered abroad, the original and copy of the marriage certificate issued by the notary organ or competent authority of the country where the marriage is registered and certified by the embassy (or consulate) of the prc in that country or by the embassy (or consulate) of that country in china shall be provided. if it is a foreign language version, the original and copy of the translation issued by a regular translation agency shall be provided.

3. proof of reasons for change: in case of divorce of the original borrower, the original and copies of divorce certificate, divorce agreement proving the ownership of house property right and debt and stamped with the seal of civil affairs bureau, or the effective court judgment and mediation statement; if the original borrower dies or is declared dead, the death certificate or the judgment of the court declaring death, proving the inheritance right of the house property right and debt ownership or the original and copy of notarization, judgment or mediation certificate of bequest certificate. people from hong kong, macao and taiwan who not registered in the mainland shall provide the original and copy of divorce certificate and death certificate notarized by notary office of residence (hong kong, macao or taiwan). foreigners shall provide original and copy of divorce certificate and death certificate certified by the embassy (or consulate) of the prc in that country or accredited by the embassy (or consulate) of that country in china.

4. provident fund loan contract: the original of provident fund loan contract.

5. property right certificate: original of real estate registration certificate.

6. repayment account: original of type i debit card under the name of the borrower after the change.

7. in case of application for change of common property right guarantee housing before 2016 batch (excluding), relevant opinions on change and adjustment issued by housing security center shall be provided.

8. other materials required by the municipal provident fund center.

v. people present:

1. application for change of on-site personnel: the borrower before and after the change.

2. the person who signs the change agreement: the borrower, the co-borrower, the co-owner of the property right and the spouse of the above-mentioned persons before and after the change.

3. if you can't come to the scene, you need to provide the notarization certificate issued by the notary organization (the notarial certificate should specify the relevant entrusted matters) and the original id card of the trustee.

vi. handling process:

1. loans accepted before august 1, 2020:

pure provident fund loan: application for change - signing of change agreement - approval of change - handling of mortgage change - completion of change;

portfolio loan: go to the original loan bank to review the change of part of the commercial loan - apply for change at shanghai estate guaranty co., ltd. - sign the change agreement - approve the change - handle the mortgage change - change the completion.

2. loans accepted after august 1, 2020:

application for change - approval of change - signing of change agreement - handling of mortgage change - completion of change.

vii.  processing time limit:

the approval time limit of pure provident fund loan is 10 working days when the information and procedures of pure provident fund loan are complete; the time limit for approval of commercial loan part of portfolio loan is subject to the time agreed by the bank, and the approval time limit of provident fund part is 10 working days.
